If SA law is anything like British law, to have charged him already means they have strong evidence he committed murder. He will be put before courts to enter plea. Remanded Then trial will be 9-12 months later to allow them to follow every lead and investigate every possible line of enquiry.

It's likely he has admitted shooting her if they have charged so soon. But probably claimed defence or accident etc. they would always charge murder and let courts decide if manslaughter or not. It's easier to drop from murder to man slaughter but you can't upgrade to murder after charging lesser offence.

Of course who knows over there..

What sickens me is if it's true that there's been allegations of domestic abuse before, it's a retelling of a story that's been told so many times before.

Woman or man gets in relationship where they're abused, report it and nothing happens which eventually leads to their death by murder/manslaugter. It's strawberry floating sickening this happens so often and even worse when it happens to abused children.

Actually, in fairness (and I say this not without a degree of experience of the situation), the problem isn't people reporting it and the action not being taken; the problem is getting victims to report it in the first place and after that getting them to stick to the charges for long enough to get a prosecution.

That's really surprising. So if the police thought someone had committed manslaughter and charged them, but then later found evidence that they committed murder the police couldn't change the charge?

Do you know what the reason for this rule is?

That's fair enough I guess. I didn't really think of that large possibility when I was posting that in a rush.

I believe the law was changed recently where domestic violence charges can't be directly dropped by the victim not giving evidence.
