Come banana split has scratched up my car. :x

I was about to head out grocery shopping yesterday and noticed my car now has three scratches along the back, the longest being about 40cm! :x :x :x

There is a playground about 20m behind my parking spot, which is at the foot of a little hill, and I've seen kids playing on that hill from time to time, my best guess is one of the little strawberry floaters did it, either by accident or on purpose I don't care but strawberry float this really pisses me off. My first ever new car and it now has not 1 but 3 big scratches down the back! :evil:

Has anyone used touch up pens? Are they any good?

Never used touch up pens but it's probably worth giving them a go before exploring other options to get it sorted. With one of the scratches being 40cm it doesn't sound like its an accident.

It will always be noticeable if you use a touch up stick and if it is 40cms, it will always stand out. In the UK we have mobile repairers who will deal with that kind of thing (and minor dents) for much cheaper than a body shop. That is probably your best option.

Leave a big dint in it. It keeps traffic off your arse on the motorway. They know you're willing to take a dent and break hard ;-)

So I has an interesting incident last night (in day light). Before I tell you, can I please not have responses trolling me calling me an idiot, just honest opinions, as I'm not really sure who was in the right wrong/ I've come to the conclusion we were both in the wrong.

So I'm on an A road in lincolnshire. You can see quite far. The situation is a tractor is front going about 30, and people take their turns to pass the tractor. I get to two vehicles behind tractor (Tractor, then a vehicle and then me) and wait for the guy ahead to move....he/she(from now on he) doesn't. The road is clear oncoming and I have time and space to pass both, so I indicate out and put my foot down.

Suddenly the car in front swings out to the right and forces me off the road. The right side of my car goes up the grassy bank and I have to ride it at about 50.

The idiot car then moves back in and then I move back onto the road. Pass the tractor and continue. About 30 seconds later I pull over....and the guy who forced me off the road does not.

Unfortunately I did not get his numberplate.

So my question is, was I in the wrong here? As far as i can see I was within my right to pass as he had not shown any intention of doing so and the road was clear (60 limit, tractor going 30). I honestly believe if I hadn't swerved i'd have gone into the side of him and it could have potentially cause a serious pile/up collision (a lot of cars behind due to tractor). Maybe I could have braked rather than swerved? But my instinct told me braking wasn't going to be quick enough as he came out of nowhere.

Either way it shook me up a little, and I am very angered that they did not pull over to check if i was ok and exchange insurance details.
My car is on it's last legs anyway, but i need it to last 3 more months!

I'd say they were in the wrong, TBH.

Overtaking is a legal manoeuvre, so you weren't behaving in an unexpected way, and it's on them to check there is nothing coming past before they pull out.

They were in the wrong, unless you were being needlessly impatient or aggressive with your overtaking.

Sounds to be that they didn't signal or check their blind spot.

In this instance you were in the wrong as it is illegal to pass two vehicles at once. Irrelevant if one of them was a tractor.

Not to my knowledge it isn't.

As long as you conducted yourself correctly (didn't cross a solid white line, signalled in advance of the manoeuvre, made sure there was clear visibility ahead and no oncoming traffic etc.) then I don't see that what you did was wrong.

The other driver did not indicate their intentions and clearly did not check their blind spot so they were being a bit of a split and could have caused a severe accident.

Also it is an offence to needlessly hold up traffic (rule 169 of the highway code) so the tractor was also in the wrong if they did not take action to expedite your ability to pass them.

That changed a couple of years ago. Now you can overtake more than 1 vehicle but only if they are the same colour.

Loads of people get caught out by that.

I would say that if you indicated giving notice (i.e. indicated and left at least a few seconds before starting your manoeuvre) and did not cross a solid white line in your overtake then the other car didn't check their mirrors before moving ( part of the "mirror, signal, manoeuvre) and so they are in the wrong and I would have considered myself not to be at fault in this incident (and I have made similar overtakes myself and would do the same again).


I wasn't familiar with the vehicle colour rule though so if it was dark you may have found yourself passing two vehicles of the same colour making you at fault.

To be fair, it can be difficult to tell with tractors, because they're covered in shite.

I've only ever had the need to overtake 2 cars at once and that was when both cars were happily going at around 35-40 mph on a straight national limit road (I got the impression they were together), it was dark though so I've no idea if they were different colours or not, I actually thought it was illegal to overtake more than one car to begin with but having a google I found that wasn't the case, first time I've heard of the colour rule though.

Anyway, the car seems to be working but the mudguard is hanging off a bit. I'll fully take it off when i get chance.

After thinking on it a few days and reading this thread, I would say both parties were at fault but the other car was more so.

I indicated and left room and moved out onto a clear space with no solid white lines or oncoming traffic. I probably accelerated too quickly though. (ie rather than moving out and then accelerating, I indicated, then half way over with my car set in direction of getting onto other side of road I began accelerating). it's taught me a lesson though. Just because something is safe for you alone to do, don't forget to include the unpredictability of other drivers. Drive more defensively, and don't take unnecessary risks.

No, the other driver is 100% at fault. You're supposed to accelerate before entering the other lane, so you don't suddenly end up with traffic up your arse. The other driver wasn't paying attention to what was going on around them. They failed to use their mirrors, check their blind spot, and signal. That's literally two thirds of what you're taught to do!
