Double Fine Strikes Back Against Activision
Brutal Legend developer files a countersuit against industry giant.

The drama surrounding Brutal Legend continues.

Double Fine Productions, the developer behind the upcoming Brutal Legend game, has filed a countersuit against Activision Entertainment last week, the AP reports.

The countersuit claims Activision, the company originally set to publish the game before being pick up by Electronic Arts, is trying to stop its release to protect the Guitar Hero franchise. It also says Activision is out to hurt the game during its "crucial marketing phase."

Caroline Esmurdoc, COO of Double Fine Productions, issued IGN the following statement:

"In 2008, Activision and Vivendi met and made a decision to walk away from Tim Schafer, Double Fine and Brutal Legend. Now that we've found a publisher and the game is getting sensational coverage, they want to stop its release," she wrote in a statement," Esmurdoc wrote.

"Double Fine's countersuit is a demonstration of our intention to fight for this game - Activision will not kill Brutal Legend."

Early last month, it was Activision who was the one doing the suing. The company sunk over $15 million into the project and still held the publishing rights for Brutal Legend despite reportedly dropping the game.

Brutal Legend is set to release this October for the Xbox 360 and Playstation 3.
