It's not an HMRC investigation so why would they use a transfer ban as punishment if West Ham or Newcastle are guilty of shenanigans? I'd imagine a hefty fine and possible criminal proceedings against those at the top would be the order of the day if West Ham and Newcastle were in the wrong.
