Cakes have a soft, spongey texture.

No! Read the links.

They have always been categorised as cakes, but the Government tried to start taxing them as biscuits. The manufacturers appealed and won.

It actually went to court and one of the memorable deciding factors was that, on going stale, a Jaffa Cake goes hard like a cake, whereas a biscuit goes soft.


So Jaffa Cakes are cakes, both in the hearts and minds of the people, and legally, from a taxation point of view. Anybody who disagrees is being wilfully belligerent.

I knew about the HMRC thing, and I still think their biscuit reasoning was ridiculous, and should never have been debated in the first place.
