Is that picture actually anything to do with MvC4 though? Or just a generic MvC picture that Polygon have used?
It doesn't really matter where the picture is from, my point was that Wolverine is so big a draw that he's featured in that bit of art(and just about every other bit of art for the entire series) - it'd be the height of stupidity to omit him now, especially given that I don't *think* there are any restrictions on the X-Men appearing in videogames.
Helps that they shoved Wolverine onto the Avengers roster the second that rights issues started popping up for the X-Men.
I'm sure Capcom would love to put Wolverine in there, but it's not really up to them. His inclusion would probably require a three way agreement between Capcom, Marvel and Fox, which I'd imagine would be an utter nightmare to organise.
To the best of my knowledge this isn't the case - there've been multiple Marvel games featuring Wolverine(and most of the rest of the X-Men) with no big studio involvement since Fox acquired the film rights; X-Men Legends, Lego Marvel Superheroes, Marvel: Ultimate Alliance, Marvel vs. Capcom 2, Marvel vs. Capcom 3 etc. If they're focusing more on Disney Marvel movie characters then that's more likely because they'll see a knock on effect from movie marketing rather than due to a rights issue. You'll still see Wolverine though, I can almost guarantee it. I'm not sure who holds the rights to the X-Men videogame franchises(Activision?) but they've been used multiple times before.
EDIT: Having said that, I remember the Fantastic Four weren't included in the MvC series, but I'm not sure whether that's because they're unmarketable or due to some strawberry float up with videogame rights.
