Playing against kids on XBL

My little brother's just got Fifa10 and we're trying to play online, but it keeps saying that he can't play as he hasn't been approved or something, although he hasn't read the full message to me he said it's something to do with being too young, but FIFA's a 3+.

He's linked it to his hotmail account so they'll know he's only 12 is this EA or MS trying to stop adults playing with kids, even when we're on each others friends lists? My Dad doesn't know what parental options he's set up on it, but my brother plays CoD online so it doesn't really make sense that they'd be allowed to play that and not FIFA.

What's going on?

EDIT: He gets the same message when trying to enter matchmaking.

Parental Control settings?

That's what I would have thought, but what setting would let you play Call of Duty online in both matchmaking and against friends, but not FIFA it doesn't make sense.

Unfortunately I'm not there to be able to check first hand.

Live season update not been done maybe?

I think it's EA, I vaguely remember there being a problem with my Nephew trying to go online on Burnout.

EA stopped me grooming children over Live.
