Imagine you were to create something immaterial. Be it music, be it a poem, be it a picture.
Now you have this awesomely awesome thing - theme, line, setup - in mind, and it somehow sounds familiar but even after loads of consideration you don't find out who was the original creator of that.
So you implement it in your works anyway.

Would you consider that as stealing/copying? Or is this different?
Discuss.

I'd say its not stealing or copying. If you came up with it yourself.

It's not stealing, no. I mean it would be (unintentionally) if you later found out you'd quoted someone else word-for-word, but even if it's inspired by something else it's not really theft. A lot of things develop as such.

Thanks for the link. I didn't refer to any actual lawsuit or so.
the truth of this matter is, that I am writing music, as some of you might know, and one part I have added today sounds familiar from somewhere. but i absolutely don't know where from... after some hesitation I added it anyway :)

Record the bit and stick it on here... someone might be able to pinpoint where it might be from.

Alternatively, Cuban Mistletoe Crisis will steal it himself and use it in Mind Bullets' next hit single.
