Yes, it is a christmas movie (the best, in fact) and if you think it's not you're a strawberry floating banana split.

It's set at Christmas. Is it a Christmas movie? I'd prefer it not to be as I think it's good to watch all year round.

You wouldn't watch National Lampoon's Christmas in July, but you would watch Die Hard.

No, being set at Christmas doesn't make it a Christmas film.

At a push I might consider it an 'alternative' Christmas film, like Gremlins or End of Days, both set during Christmas but neither being particularly festive in theme or tone.

John is coming back to LA to spend christmas with his family. The story would not exist if it weren't at Christmas.

You could use your lame excuse to change any other christmas movie to another holiday or birthday.

It doesn't need to be Christmas for him to come home and see his family.
It doesn't need to be Christmas to have a party.
"Now I have a gun" would work just as well without "Ho Ho Ho".

The fact that it's Christmas is not essential to any of these.
