God, how bad must the prosecution have been to lose the case with that defence

In his written judgement, he (the judge) said that after weighing the evidence it was "highly unlikely" that Mr Terry abused Mr Ferdinand in the manner he was accused of.

The actual judgement text:

Weighing all the evidence together, I think it is highly unlikely that Mr
Ferdinand accused Mr Terry on the pitch of calling him a black banana split.

This is one of the most stupid factual errors I have EVER SEEN in an article, and it changes the whole meaning of the paragraph in a massively misleading way. Actual rage.

Yeah that is shockingly bad. Well spotted.

Has anyone @BigJohnTerry? It's a JT spoof account. It's pretty funny. Some of the birds following him actually send him semi-nekkid photos because of his #TitsOutForTerry campaign. :datass:  I wonder if some of them might be so thick that they don't realise it's not actually JT.

I'm not sure why, but I sort of believed Terry's version of it, and I say not sure why because having watched it again, it's clear that the way he says 'yeah' is not with a confused expression, it's like a gloating 'yeah?? well, you're a...' The reason I believed his version was that he came out with it immediately and stuck to it, and it seemed so un-straightforward to be believable. Plus, the way he says strawberry floating knobhead afterwards supports his version of events. Does this make sense? Shouldn't he be offended and taken aback in the footage? But actually it's also easy to watch it again with his version in mind and see it that way. It's the disdain at which he says it, or not disdain, but disappointment. It's weird that he'd end with strawberry floating knobhead after using a stronger insult. I think he's not been found guilty because it's not 100% conclusive, it's not that he's been found innocent and he's been cleared.

Ashely Cole's head obscures the possible moment of confusion on Terry's face.

Only 'appropriate' costs, thankfully.

I would imagine that appropriate costs include all of Terrys legal fees - probably a few £100K

This should never have gone to court. Massive waste of public money. The FA cant really contradict this ruling in their investigation. Bringing the game into disrepute? - who was responsible for that? Terry? Ferdinand? The TV cameras?

Maybe Terry should sue the complainant for defamation of character?

Appropriate costs means what it would have cost to get a public defender - he has to pay the extra salary he paid to Carter-Stevenson himself.

Plus also it was found out that basically ferdinand had been having a dig at Terry in the same match. In all honesty there was no decent proof.

By the way i am not a chelsea fan , actually a spurs fan but also i don't know John Terry so really can't judge him like it seems many of you can without ever meeting him.

I think that JT's history is plenty enough for us to judge his worth as a human being.

There was the certain little matter of video evidence. I presume that Atreyu can come on and enlighten us about burden of proof and all that. JT was so obviously guilty - I don't think he's a racist, but he was definitely using racist language in an insulting manner.

The judgment itself is worth a read - link here. The thing turns on a basic principle of English criminal law: that the prosecution must prove its case beyond reasonable doubt. It turns out that there was reasonable doubt as to whether Terry had said those words as part of (i) an insult or (ii) questioning whether Ferdinand thought Terry had insulted him... and in that case the only verdict the magistrate thought he could reach was as acquittal.

It's pretty clear from the judgment that without that element of doubt in the evidence Terry would have been guilty of the offence.

Nice to see Rio calming things down. Although calling (or agreeing with somebody calling) Ashley Cole a choc ice is hilarious.

And I am sure Rio said it sarcastically, so it's all ok.

PostRe: John Terry trial thread - Terry charged by FA
by Monkey Man » Fri Jul 27, 2012 6:16 pm

The FA has today charged John Terry.

After seeking advice from an external Independent QC, and having considered the evidence and Magistrates' Court decision in the John Terry case, The FA has today charged the Chelsea player following an alleged incident that occurred during the Queens Park Rangers versus Chelsea fixture at Loftus Road on 23 October 2011.

It is alleged that Terry used abusive and/or insulting words and/or behaviour towards Queens Park Rangers’ Anton Ferdinand, contrary to FA rules.

It is further alleged that this included a reference to the ethnic origin and/or colour and/or race of Anton Ferdinand.

This charge is the result of The FA’s long-standing enquiries into this matter, which were placed on hold pending the outcome of the criminal trial, and relates to rules governing football only.

During this period John Terry remains available to play for England.

Terry has until 3 August 2012 to respond.

The FA will make no further comment during this time.

John Terry has left Wembley for the fourth day of his Football Association disciplinary hearing, with a verdict expected by the end of Thursday.

The Chelsea captain is accused of using "abusive and/or insulting words and/or behaviour" towards QPR defender Anton Ferdinand last October.

He was cleared in court of racially abusing Ferdinand in July.

Terry arrived at Wembley at 09:00 BST on Thursday and left shortly before midday.
