Yes and No.

If someone breaks into your house, the probable things that will happen when you discover this are all based on fear for oneself and fear for others.

The criminal will either

a) Get scared and run away
b) Fight his ground a little, either injuring you or being injured himself in the process before leaving
c) Get to a point of no return where murder seemingly is the best choice at the time
d) Due to the fight inbetween the two of you one of you dies by accident, unintentionally.

If someone breaks into my house I would beat the gooseberry fool out of them. Or to be more precise, damage them until they can't be a threat to me no more. If I discover a thief in my house, I've no idea what weapon he might be carrying, or if he's going to rape a family member as well as steal. So naturally I'll attack him. If he continues attacking me back, I will attempt to break his arm or his leg someway of stopping him from becoming a huge threat, then the choice would appear do I let him go or do I attempt to keep him somehow until the police arrive?

The story reported a few weeks back about the family chasing after the thief and leaving him a bloody pulp is a big no -no. I might chase after him, to hit him, or recover my goods and get him/her for the police, but I would never beat the gooseberry fool out of him on purpose.

If we allow people to take all measures to defend themselves it will just cause the burglars to expect that and use more force themselves. When someone said that if we could defend ourselves to the full and this would stop the problem I instantly thought of how the USA has that situation now and I'm fairly sure they still have burglars.

I think the idea of reasonable force is about right and if you have used reasonable force to defend your property a Jury should be able to see that and act accordingly.

I'm sorry to quote just this but but for me it's that he continues to batter the guy even when he's on the floor and no longer a threat to anyone.
To me it's like when people have a fist fight outside a pub you might just both forget it and walk away blaming the drink if all that happens is one person decks the other and then stops but if he then starts kicking the crap out of the guy on the ground it becomes a whole different matter.

What got me was the public outcry and the papers spinning the story, he wasn't protecting himself by chasing after him and then proceeding to almost kill him, he was breaking the law, becoming worse than the thief in my view

Nay worries bud - no offrence taken. And to be fair the guy's ok in my book.

That Iraqy comedian lady was on the other week. I thought she was crap from the bit I saw.

I'd probably do her though. Just for fun.
