So I bought Burnout 3 ages ago on XBLM, but I went to redownload it today and it's not on the marketplace. I looked on the website and it is on there, but it says 1200msp. If I click to download it, will it deduct my points even though I've bought it in the past?
Are you sure you're using the same XBL account you used to buy the game in the first place? If so, and it's in your purchase history but you can't download it, then you should email xbox support and ask for the points back.
