They want to offer £4250 as their absolute final offer.

I've told him to email the offer and I'll consider it.

Pricks definitely know they'll lose. Do I risk losing everything for the sake of £250, or just take it and move on before I have a complete breakdown with the stress of all this gooseberry fool.

strawberry float this is a hard one (no context).

Under what terms is it being offered though?

I want you to take them to the tribunal as they've mugged you off completely and even at £4,250 they've come away with £1,750 of your money + a bunch of your time. But it's not my money so I know it's a completely different consideration.

I think for £250 to resolve the matter it's worth consideration.

I personally would not accept because:

a) Why should we have faith that such a payment would ever materialise
b) How do I know they won't start adding on trumped up expenses onto your freehold under the "oh something we did ages ago and we forgot to bill you for umbrella
c) How long did it take to get to this point where a tribunal is ready? I don't want to wait that long again if they find some kind of loophole to have the chance for some kind of legal ruling which properly once and for all draws a line under this bullshit.

There is always a chance the tribunal doesn't go your way (unlikely, but always a chance), but at least whatever the outcome, they will be forced to accept it and to do what they are told.

Easy for me to say that though because I'm not the one in the situation.

What do you mean?

It's an out of court settlement. They've confirmed it'll settle everything at their end. If I agree, they pay me and I cancel the legal action.

Is there some terms I should be wary of?

I would be wary because, if your tribunal is tomorrow (is it?), you have no time for a solicitor to run an eye over the agreement to see if they have left themselves a backdoor or two.

All true.

I've already said (on my previous offer) that I wouldn't stop legal action until it was in my bank account. And I said I would require confirmation that it'd settle EVERYTHING to date.

There's a good chance they'll try it on again in future. But they'll probably do that whether I settle, whether I win the tribunal or if I lose the tribunal.

I feel drained with all this gooseberry fool. I'm seriously close to accepting and ending this gooseberry fool.

It's not really £250, it's technically £1750 as he's already decided to accept £1.5k to resolve the matter.

From my sofa it's very easy for me to say I would go to tribunal, for the reasons Drummy listed. I think you've shown you've been reasonable and were willing to take a £1.5k loss to close the matter, which they wouldn't offer.

Oh it's far more than that, I shouldn't have been liable for any of it.

I'm going to accept though. I need to end this as I've spent years stressing over it all and I need it to be over.

Very fair, sounds like this is the right decision for you.

Enjoy that peace of mind - you have thoroughly earned it!

Cheers.

I expect the peace of mind will only last a day or two before the twats do something else, but at least this saga is over and I know far more about how to fight the bastards.

I need covid to strawberry float off so I can look to get out of here.

I wouldn't accept, if they can come up that far they know they are going to lose.

I know. And I know what I'd be saying if it was anybody else.

I just can't take any more of this gooseberry fool, especially if they act like lying banana splits during the tribunal. I've had years of it and just want it over.

However, been years of this gooseberry fools what's a few more weeks. They can only lie so much as they need proof of anything they say, so just just bullshit it.
They wouldnt be hoping the offer this much if they had any hope of winning.

Been in our house for a month now. Two rooms decorated, most furniture acquired (sofa shops closing is frustrating), but we're not quite as far as we intended to be at this stage. Our garden waste bin came today though, so was able to hack away at the bushes which block half the light out of the lounge.

The silly neighbourhood vegetable.

I've accepted and am awaiting payment. They've got until 10am tomorrow to get it to me, the case management hearing with the judge is booked in for then.

They've assured me it'll be in my account in the morning. We'll see!
