Technically he shouldn't be able to as he was born outside the US. Although I think a court in the US ruled that this right is upheld by the voting public, so I'm not sure any legal action would stop it happening. That said I'm not sure he'd want to run.

There's a bunch of sexual harassment stuff starting to come out so one theory is that Musk is basically trying to spin everything as a liberal attack on him before details come out so he can try and control the narrative a bit better.

That's exactly what he's done. Journalists often call the subject of a story before it is released. Musk either got a phone call or somebody tipped him off. He's then tried to get ahead of it with his "oh I'm Republican, watch all the smear stories start up now I've said that LOL!".
