Yeah not to sure about that also the 39 is light level but I believe it was pretty much stated next level cap was 35 (maybe rumours)

Well that's six of us for a VoG at 9:30 then if we're all good for that? Anyone still need to do the Nightfall before hand?

Yes but they always seem really difficult, to me. All of those modifiers scare me.
